Terms and Conditions

For home care services staff discount program

 

1          Preamble

1.1        Mercy Health Home Care (Mercy Aged and Community Care Ltd ACN 088 254 460 ABN 77 191 901 062) wishes to offer a staff discount to eligible clients (the staff discount program).

1.2        a client is eligible for the staff discount program if the client has a home care package under the Aged Care Act 1997 (Cth) and is a family member of a Mercy Health staff member or volunteer.

1.3        the staff discount program is offered on these terms and conditions and any additional terms and conditions communicated to staff members and volunteers by Mercy Health Home Care from time to time.

2          Definitions

2.1        Family member means a person who, at the time the client applies to the staff discount program, is related to a staff member as a spouse; a parent or stepparent; a parent-in-law; a sibling; an aunt; an uncle; a nephew; a niece; or a child.

2.2        Staff discount means the application of a 10% discount to the fees and charges set out in the pricing schedule to the home care agreement of a client who has a home care package under the Aged Care act 1997 (Cth), and to the fees and charges set out in the pricing schedule to the home care agreement of a client who is receiving services on a private basis.

2.3        Staff member means a person who is an employee of Mercy Health at the time the client applies to the staff discount program.

2.4        Volunteer means a volunteer who has served with Mercy Health Home Care for no less than six months at the time the client applies to the staff discount program.

3          Redemption process

3.1        a client redeems the staff discount by submitting a staff discount program application form to their local Mercy Health Home Care office.

3.2        the staff discount program application form must:

(a)        specify the full names of the client, staff member or volunteer;

(b)        specify the relationship between the client and the staff member or volunteer; and

(c)        be signed and dated by the client and the staff member or volunteer.

3.3        by signing the staff discount program application form, clients, staff members and volunteers:

(a)        acknowledge that their participation in the staff discount program is subject to these terms and conditions;

(b)        Mercy Health reserves the right to modify or terminate the staff discount program, in whole or in part, at any time and will make reasonable efforts to notify you as soon as practicable, without being under any obligation to do so;

(c)        these terms and conditions shall be governed by and construed in accordance with the laws of Victoria and any disputes arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Victoria; and

(d)        consent to the collection, use and disclosure of personal information for the purposes of the staff discount program;

(e)        confirms that the information provided in the application form is true and correct.

3.4        if the client meets the eligibility requirements for the staff discount program, then:

(a)        if the client holds a home care package on the day that the application form is submitted, the staff discount commences on that day; or

(b)        if the client does not hold a home care package on the day that the application form is submitted, the staff discount commences on the day that the client’s home care package commences, provided that the package commences;

(c)        if the client is paying private fees on the day that the application form is submitted, the staff discount commences on that day;

(d)       if the client is not paying private fees on the day the application is submitted, the staff discount commences on the day that the client’s private home care agreement is signed.

4          General

4.1        the staff discount program applies to new and existing clients of Mercy Health Home Care.

4.2        benefits arising from participation in the staff discount program are non-transferable and may not be exchanged for cash or any other alternative benefit.

4.3        only one staff discount can apply to a client at any given time.  Clients are not entitled to multiple discounts even if they have more than one qualifying family member.

4.4        the client will continue to receive the staff discount after the client’s qualifying family member ceases employment or voluntary service with Mercy Health.

4.5        Mercy Health retains the right to revoke participation in the staff discount program in the event that employment or voluntary service has been terminated in circumstances warranting summary dismissal.

4.6        Mercy Health Home Care may amend or revoke these terms and conditions at any time.  While Mercy Health Home Care will make reasonable attempts to notify you of any amendment or revocation of these terms and conditions, it is not required to do so and may alter or revoke the staff discount program at any time.
